These terms apply to this website and to services purchased from Pine State Creative. Your checkout and service agreement provide the final project-specific details.

Acceptance of these terms

By using this website, submitting information, or purchasing a service, you agree to these terms. A project may also be governed by a checkout summary, proposal, order form, or service agreement. If a project-specific agreement conflicts with these website terms, the project-specific agreement controls.

Services and project scope

The project configurator identifies the selected package, pages, forms, features, add-ons, billing schedule, and price before checkout. Submitted intake information becomes the working direction for the project. Requests that add deliverables, materially change the approved direction, or expand the submitted scope may require additional pricing and approval.

Customer information and materials

You are responsible for providing complete and accurate information and timely approvals. You represent that you own or have permission to use all names, logos, photographs, copy, trademarks, data, and other materials you provide. You are also responsible for reviewing final content for accuracy, including business claims, prices, policies, spelling, and required disclosures.

Payments, recurring billing, and taxes

Payment must be completed before a new project intake is submitted for production. The amount and billing schedule shown at checkout are the amounts you authorize. Managed website services renew on the selected monthly or annual billing schedule until canceled under the applicable agreement. Annual prepayments cover the stated annual service period. Applicable taxes may be added when required.

Except where required by law or expressly stated in a written agreement, payments are nonrefundable because time, production capacity, software, and third-party resources are reserved when an order is placed.

Initial term, cancellation, and website ownership

Managed website packages may include an initial agreement term described at checkout or in the service agreement. You may stop future service as permitted by that agreement. Full website ownership transfers after completion of the initial agreement term. If service is canceled before that term is complete, transfer may be completed by paying the remaining balance stated in the agreement. Customer-owned domains and customer-provided materials remain the customer's property.

Revisions and approvals

Unless a specific offer states otherwise, a project includes three consolidated change requests. Each request should identify the changes needed in one complete communication. Additional requests, major changes, new direction, or expanded scope may be priced separately. Approval authorizes Pine State Creative to proceed using the approved work.

Ownership and licenses

Final ownership and transfer timing are defined by the applicable service agreement. Third-party software, fonts, stock assets, platforms, and licensed components remain subject to their own licenses. You grant Pine State Creative permission to use completed, non-confidential work in portfolios, case studies, social media, and marketing unless we agree otherwise in writing.

Third-party services and usage charges

Hosting, domains, payment processing, email marketing, ecommerce, booking, analytics, and other features may rely on third-party providers. Provider availability, acceptable-use rules, transaction fees, contact or storage limits, and usage overages may apply. Charges that exceed an included limit may be billed as described in the project configuration or service agreement.

Acceptable use

You may not use the website or purchased services for unlawful, fraudulent, infringing, abusive, malicious, or deceptive activity. We may decline or suspend work that creates a material legal, security, reputational, or operational risk.

Availability and limitation of liability

Services are provided with reasonable professional care, but uninterrupted availability and error-free operation cannot be guaranteed. To the maximum extent permitted by law, Pine State Creative is not responsible for indirect, incidental, special, or consequential losses, or for failures caused by customer materials, third-party providers, internet outages, unauthorized changes, or events outside our reasonable control. Our total liability relating to a claim will not exceed the amount paid for the service giving rise to that claim during the preceding 12 months.

Changes and governing law

We may update these terms by posting a revised version with a new effective date. These terms are governed by the laws of the State of Maine, without regard to conflict-of-law rules.
